subscribe to fou d'la bouffe and create an Account on the Site. The officers, directors, employees, agents and
Representatives of Fou d'la Bouffe and its affiliates are eligible to participate in the program,
but may be excluded from certain promotions.
Loyalty points
Loyalty Points are points with a monetary value that you can use to obtain
discounts on all our products. These are granted to you based on your purchases and the actions
that you make as a subscriber of fou d'la bouffe, in order to recognize your commitment
and your participation. If we cancel part of your order, if you request a refund
partial or complete, or if you make changes to an order confirmed with our
customer service, the amount of Loyalty Points granted will be adjusted later. Dots
accumulated Loyalty Points are reserved for the Account associated with them and cannot under any circumstances be
transferred to other members of fou d'la bouffe. Available Loyalty Points never expire
and can be used at any time, unless your account has been deleted by you or at your request.
Terms of use of Loyalty Points
There is no minimum number of Loyalty Points to get a discount. You can use your
Loyalty points at any time to get discounts on any product, even
if you have only accumulated one Loyalty Point.
The number of Loyalty Points needed for a discount will be indicated for each product.
Once you have used your Loyalty Points, the transaction is final and cannot be corrected under any circumstances.
Modification of the Crazy Food Loyalty Program
We reserve the right to modify the terms and conditions applicable to your participation
to the Crazy Food Loyalty Program. The following may be subject to change over time:

Acceptance of Terms: By using our affiliate program ' Crazy about food Associate ',

If you do not agree to these terms, you must immediately stop using our affiliate program.
Eligibility: To be eligible for our affiliate program, you must be at least 18 years old and have an account
PayPal active to receive commission payments.

relating, including, but not limited to, your User Submissions, Third-Party Sites, or any
use of the content, services and products of the Fou d'la Bouffe website other than expressly
permitted in these Terms and Conditions of Website Use or the Terms and

Applicable law and attribution of jurisdiction
The Crazy Food Website and these Website Terms and Conditions of Use are governed by and
construed by the laws of the Province of Quebec, Canada and the laws of Canada therein
applicable, without giving effect to any choice of legislative jurisdiction, conflict of law rules,
provisions or principles (either laws of the province of Quebec or any jurisdiction)
regardless of your domicile, place of residence or actual location.
Any action or proceeding arising out of or relating to the Crazy Food Website and under these

of Quebec and/or before the Federal Court of Canada, and each party submits

or other associated platforms and devices (collectively, the “ Crazy Food Website ").
The Crazy Food Website and all the services
provided at all times and from time to time by fou d'la bouffe or on behalf of fou d'la bouffe (including the
Delivery Service) will be collectively referred to below as the “ Service. » When used
in this document, the term “person(s)” refers to individuals and entities.
The Terms and Conditions of Sale apply to persons who purchase the Products
and/or the Service or who access the Products and/or the Service. Please read these Terms and

subscription for the delivery of prepared meals on a recurring weekly basis (the “Subscription”)
is not yet available, it will be added soon. However, even with the Subscription,
you can always order other products individually.
If you create an account and place your first order, you provide your email address
as well as the postal code of the place where you want the products to be delivered. After having
selected the products, you provide your full delivery address and payment information.
A deadline for the order will be displayed at the top of the "My Account" page.
Each Order is subject to acceptance by fou d'la Bouffe, and we will notify you of acceptance.

(iv) that you will pay the charges incurred by you at the price displayed, including any applicable taxes.
If the payment method associated with your order is declined, we may attempt to charge
any other payment method associated with your order, if available. To terminate your authorization
to charge a payment method or to change the payment method, please contact us

using any other means stated on the crazy food website.
We are not responsible for any transaction that cannot be authorized by
our payment processor, including, but not limited to, due to insufficient funds
on your credit card. If such a situation occurs, you will receive an error message and
the transaction will be refused and cancelled.
Delivery
Generally, fou d'la bouffe uses third parties for the Service. Consequently, all
Products delivered under the Service are delivered pursuant to a shipment contract in
under which title and risk of loss of the Products pass to you once the
products are delivered to you.
Type of delivery
Delivery will be made to the address you have entered in your Account for your
Orders. For Call-ups, you can change the delivery address to
your Account before the Deadline. For orders placed in the Food Account under
empty, there is no way to change the expected delivery date once any order
past, unless you contact us at support@foubouffe.com; We
will therefore determine, at our discretion, whether we will allow you to change your date or
time of delivery (or if possible).
Delivery time
Although Crazy About Food will endeavour to deliver the Products in accordance with the delivery times
mentioned in your Account, when this is not possible, fou d'la bouffe will inform you
immediately and will inform you of the new scheduled delivery time.
Please note that all shipping times and dates are estimates and lead times
Actual delivery may vary due to weather and other factors,
some of which may be beyond our control.
In the event that we are unable to deliver your Products, we will issue you a
credit corresponding to the purchase price of this order to your Account.
Notwithstanding the foregoing, you are responsible for the full value of your order if
we are unable to deliver to your confirmed address on the day
specified for reasons caused by you. You are also responsible for all costs
incurred by fou d'la bouffe relating to a second attempt to deliver the Products, unless otherwise agreed

Waiver of custody of the Products
We consider the Products delivered upon arrival of the third-party delivery service and we waive
custody of the Products in accordance with the delivery instructions specified by you in
your Crazy Food Account. When delivery is made to an address specified by you, we
assume that anyone present at the location specified in the delivery instructions
is authorized to receive delivery on your behalf. If there is no one at the address given in
delivery instructions, we will leave the package unattended at the address you have
indicated. You are responsible for ensuring that any delivery instructions provided to us
provided are complete. We are not responsible for any delivery errors caused
by the inaccuracy of the information provided or by its incomplete nature or the deadlines and/or
damage caused by such errors.
Inspection of the Products received
Once you have received delivery, you are responsible for inspecting all
products received for any damage or other problem resulting from their delivery. You are
responsible for determining the freshness of the Products you receive. If the products are not
no charge when they are delivered, please let us know and we will deal with the problem

Product handling and food safety
Following delivery of the Products, the condition and consumption of the Products are at your
own risk, and you are entirely responsible for washing, handling, preparing,
store, cook, use and consume the Products properly and safely.
fou d'la bouffe declines all responsibility for any action or inaction of these third parties and/or its
agents and for any delay or loss of any kind occurring while a
shipment is in the custody or control of a third party.
Our boxes include insulating liners and ice gel packs that keep
your ingredients cool several hours after delivery. However, we
recommend keeping the season and temperatures in your area in mind when
delivery and plan deliveries and storage accordingly.
Upon receipt and following inspection of any delivered Products, you must immediately
refrigerate all perishable items and are responsible for following the instructions of
refrigeration, food safety, safe food handling and
food consumption recommendations for at-risk groups (i.e. women
pregnant, young children, the elderly and people with impaired system
weakened immune system) from the Ministry of Agriculture, Fisheries and Food of Quebec
(MAPAQ) (or in Ontario, Ministry of Agriculture, Food and Rural Affairs,
OMAFRA) and the Canadian Food Inspection Agency (CFIA) to reduce the risk of
foodborne diseases.
We sell products containing nuts, soy and other allergens, and some
Products may have been prepared in the same environment as these allergens. Although
we ensure that the information we provide about each product displayed
on the Crazy Food Website is up to date and that we regularly consult our partners at
about their food processing practices, please note that we cannot
not guarantee the absence of allergen.
Account Deactivation and Deletion
Since it is possible to purchase the Products and access the Service as a guest without an Account,
Deactivation or deletion of your Account does not necessarily result in termination of these
Terms and Conditions of Sale.

deactivate, delete your account without giving the reason for our decision. We reserve ourselves
also the right to suspend, deactivate or delete your account at any time if you

Risk and Ownership
Please note that the description or availability of the Products is specified in the sections
respective terms of the Crazy Food Website and are subject to change without notice. Although the
Products on the Crazy Food Website are presented as accurately as possible, the
representation by means of photos, images, colors, sounds or any other means
is for reference only and does not imply any guarantee as to the characteristics of the Product

We may occasionally offer gift cards, promotional discounts and other
types of products (the Special offers ") requiring to be activated online to receive
the benefits associated with their use or potential use for the purchase of Products by you or by
a third.
The following rules apply to the use of Special Offers: Each Special Offer is only valid
only when used during the period specified on the Crazy Food Website or in your Account.
A Special Offer is subject to being fully applied at the time of the transaction

Special Offers can only be used once, and only one Special Offer can

Any decision taken by fou d'la bouffe regarding a dispute relating to any Special Offer that we

Referral Program: Referral Codes and Credits
You are granted the opportunity to receive benefits if, as a result of your
recommendation, any new customer creates an Account and places a First Order of

WILL BE CORRECTED. ALL INFORMATION PRESENTED ON THIS SITE IS SUBJECT TO
TO CHANGE WITHOUT NOTICE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF

availability, performance, compatibility, fitness for a particular purpose, quality,
correspondence to descriptions and non-infringement, all expressly excluded
hereby.
To the fullest extent permitted by applicable law, fou d'la bouffe, its parent company, its
subsidiaries, affiliates or any of its officers, directors, employees, agents,
service providers, contractors, licensors, licensees, suppliers
and successors incur no liability whatsoever, whether based on a contract, a
tort, quasi-tort (including negligence), strict liability or otherwise, for
any incidental, indirect, consequential, special or punitive damages, or for loss of
revenue or profits, loss of business or goodwill, loss or corruption of, or access
unauthorized to, or disclosure of information or data or other financial loss
arising out of or in connection with the use, performance, failure or interruption
(as applicable) of the Products, the Service or the Account or any other service offered by
crazy about food or otherwise mentioned herein, whether foreseeable or not, and
this, even if the company has been advised of the possibility of such damages.
In the event that Fou d'la Bouffe will be held liable to pay you for damages, the
total cumulative liability of fou d'la bouffe to you under these Terms and Conditions
of sale will be limited to the price paid by you for the Products and the Service for the last
Order placed in your Account. These limitations of liability will not be
affected if a remedy provided fails of its essential purpose.
Compensation
You agree to defend, indemnify and hold harmless fou d'la bouffe, its
officers, directors, employees, agents, service providers, contractors,
licensors, licensees, suppliers and successors of any claims,
liability, damage, loss and expense, including, but not limited to, costs
reasonable legal and accounting, arising in any way from your
access to or your use of the Products, the Service, your or any information displayed
or communicated by you on the Fou d'la bouffe website or any other forum.
Written communication
Applicable laws require that some of the information and communications we
send you must be in written form. When you use the Crazy Food Website, the
web applications and mobile applications, you agree that communication with us is
done mostly electronically. We will contact you by email or you
provide information by posting notices on our website or through our
web applications or our mobile applications, at our discretion. For contractual purposes,
you accept this means of electronic communication and you acknowledge that all
contracts, notices, information and other communications that we will provide to you via
electronically comply with legal requirements requiring communications to be
made in writing. This condition does not affect your statutory rights.

We may send you correspondence to the email address or postal address
that you have provided to us when placing an order or as set out above
in the section " Written communication. » Correspondences will be considered as
duly received and served immediately when posted on our Website,
24 hours after sending an email on the date of sending any mail.
To prove the delivery of the correspondence, it will be sufficient to prove, in the case of a
letter, that it has been correctly addressed, stamped and sent by post and,
in the case of an email, that it was sent to the specific email address of the
RECIPIENT.
force majeure
We shall not be liable for any delay or failure in performing any
of our obligations under a Contract, which would be caused by events outside our
control (“Force Majeure Event”).
A Force Majeure Event consists of any act, event, non-occurrence, omission
or accident beyond our control and includes in particular, but not exclusively, any strike,
containment or other industrial action; civil disorder, riot, invasion, terrorist attack or
threat of terrorist attack, war (declared or not) or threat or preparation for war;
fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic
(such as the 2019 pandemic of the novel coronavirus [COVID-19] and its variants), tsunami and
any other natural disaster; impossibility of using the railways, shipping by
boat, aircraft, motorized transport or any other means of public or private transport;
inability to use public or private telecommunications networks; and act, decree,
laws, regulations or restrictions of any government.
Our obligations under these Terms and Conditions of Sale are suspended for the
period during which the force majeure event persists, and we will benefit from a
extension of time for the execution of the contract, corresponding to the duration of this period.
We will endeavor to bring the Force Majeure Event to an end or to find a
solution through which we can perform our contractual obligations despite
Force Majeure Event.
Amendments
We may modify the Terms and Conditions of Sale, in whole or in part, at
any time without notice. The most up-to-date version of the Terms and Conditions of Sale
will be published on the Crazy Food Website and it is your responsibility to review the Terms and
terms of sale and to ensure that you accept the most recent version of these
before placing an Order for any Products or accessing the Service

Waiver

right or any remedy arising out of these Terms and Conditions of Sale does not constitute
a waiver by us of such right or remedy, and no single performance or
partial of any right, remedy, power or privilege hereunder does not preclude
the subsequent exercise of that right or any other right, remedy, power or privilege.
Full Agreement
These Terms and Conditions of Sale and all documents referred to therein
expressly constitute the entire agreement between you and fou d'la bouffe, and replace any
previous discussion, correspondence, negotiation or understanding between you and us relating to
subject of this agreement.
Non-appeal
We each acknowledge that, by accepting these Terms and Conditions of Sale, none of
we will not make any representation or warranty (whether made innocently or
negligently) that is not set forth herein, or to which this
document does not refer. Each of us agrees that our sole responsibility for
representations or warranties set forth herein (whether made
innocently or negligently) will be for breach of contract. This clause does not limit
or exclude any liability for fraud.
Non-partnership
Nothing in these Terms and Conditions of Sale constitutes a partnership or joint venture.

Non-right of third parties

right, remedy or equitable claim under this Agreement and its provisions, to
the exception of (i) the parent company, subsidiaries and affiliates of fou d'la bouffe and (ii) its
officers, directors, employees, agents, service providers, contractors, donors
licensors, licensees, suppliers and successors, all of whom may benefit
all disclaimers, exclusions and limitations of liability, and all other
rights and remedies described in these Terms and Conditions of Sale which they may or
could benefit.
